These Terms & Conditions (“Terms”) govern your use of the website at annacirlot.com and describe the relationship between you and Anna Cirlot Photography & Design (“we,” “us,” or “Anna Cirlot Photography”) when you inquire about or book photography services. By using this site or entering into a service agreement with us, you agree to these Terms.

1. Services

We provide professional photography services, including but not limited to wedding, engagement, portrait, and family sessions. The specific services, deliverables, timeline, and fees for your project are set out in a separate written agreement or proposal that you sign (or confirm in writing) before the session or event. If anything in these Terms conflicts with your signed agreement, the signed agreement controls for that booking.

2. Booking, retainer & payment

Dates and services are not reserved until any required retainer or deposit is received and, where applicable, a contract is executed. Payment schedules, cancellation terms, and refund policies for your specific booking are defined in your individual agreement. Late payments may delay delivery of images or release of galleries until the account is current.

3. Cancellation & rescheduling

Cancellation, rescheduling, and weather-related policies depend on your signed contract and the type of session. Please refer to your agreement or contact us as early as possible if your plans change.

4. Copyright & license to you

Anna Cirlot Photography & Design retains copyright in all photographs created under your booking. Unless your agreement states otherwise, you receive a non-exclusive license to use the delivered images for personal, non-commercial purposes (e.g., prints, sharing with family and friends, social media for personal accounts). You may not sell, license, or sublicense the images to third parties, use them for commercial advertising without written permission, or alter or crop images in a way that misrepresents the work. Credit is appreciated when sharing publicly when practical.

5. Our use of images & model releases

We may request permission to use select images for portfolio, website, social media, submissions, and marketing. Any such use will follow the model release or usage terms in your agreement. If you have privacy concerns, discuss them with us before or at your session.

6. Delivery

Editing and gallery delivery timelines are estimates and may vary by season and workload. Your agreement or welcome materials will describe typical turnaround. We are not responsible for delays caused by circumstances outside our reasonable control.

7. Conduct & cooperation

We reserve the right to decline or end services if circumstances are unsafe, abusive, or materially interfere with our ability to perform. Fees already earned may be retained as described in your agreement.

8. Limitation of liability

To the fullest extent permitted by law, our total liability arising from your use of this website or from photography services is limited to the fees you paid us for the specific booking giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, or for loss of images due to events beyond our reasonable control (including equipment failure, third-party platform outages, or force majeure), though we take reasonable steps to back up and safeguard files.

9. Website use

You agree not to misuse this site (e.g., scraping, attempting unauthorized access, or transmitting malware). Content on this site is owned by us or used with permission and may not be copied for commercial use without consent.

10. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the site after changes constitutes acceptance of the revised Terms. Bookings already under contract remain governed by the agreement in effect when you booked, except where law requires otherwise.

11. Governing law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules, except where prohibited by law.
